What is EPR?
Extended Producer Responsibility (EPR) refers to the obligation of producers to manage their products' environmental impact until the end of their lifecycle. As per the amendment to the Plastic Waste Management Rules on February 16, 2022, all PIBOs and Plastic Waste Processors must comply with the EPR guidelines.

Who Needs to Register for EPR?
The following entities must obtain an EPR registration certificate on the centralized EPR portal developed by the CPCB:

  • Producers

  • Importers

  • Brand Owners

  • Plastic Waste Processors (Recycling, Waste-to-energy, Waste-to-oil, Industrial composting)

Key Responsibilities of PIBOs
PIBOs are required to:

  • Register on the EPR Portal developed by CPCB.

  • Submit an Action Plan detailing their compliance strategy.

  • Fulfill obligations for Recycling, Use of Recycled Content, Reuse, and End-of-life Disposal.

  • Optionally engage in the collection and recovery of plastics.

  • Submit Annual Returns documenting compliance with EPR targets.

  • Provide proof of compliance through Plastic Credit Certificates issued by Plastic Waste Processors (PWPs).

Meeting EPR Targets
PIBOs must collaborate with authorized Plastic Waste Processors and obtain certificates based on the amount of plastic waste processed. Non-compliance can result in environmental compensation and disciplinary action.

While PIBOs can work with Producer Responsibility Organizations (PROs) or other agencies to meet their targets, the responsibility for compliance and reporting lies solely with the PIBOs.

Plastic Packaging Categories & EPR Registration Documents

Categories of Plastic Packaging under EPR
Extended Producer Responsibility (EPR) applies to the following plastic packaging categories:

  • Category I: Rigid plastic packaging

  • Category II: Single-layer or multilayer flexible plastic packaging (more than one layer with different types of plastic), plastic sheets or similar materials, covers made of plastic sheets, carry bags, plastic sachets, or pouches.

  • Category III: Multi-layered plastic packaging (at least one layer of plastic and at least one layer of material other than plastic).

  • Category IV: Plastic sheet or similar materials used for packaging, as well as compostable plastic carry bags.

Documents Required for EPR Registration of PIBOs/PWPs
The following documents are necessary for obtaining EPR registration:

  • PAN, GST, and CIN of the Company

  • IEC (Importer Exporter Code) for importers

  • Aadhar / PAN of the Authorized Person

  • DIC Registration (if the unit is registered with DIC)

  • Process flow diagrams (required for producers and Plastic Waste Processors)

  • Consents issued by SPCB/PCC (if the unit has a production facility)

  • Scanned copy of the signatures of authorized persons

  • Covering letter

  • Geo-tagged pictures of the following areas (for Plastic Waste Processors only):

    • Raw material storage area

    • Production area

    • Product dispatch area

    • Plant machinery

EPR Registration Process for PIBOs & PWPs

Process of EPR Registration
To obtain EPR registration for Plastic Waste Management, PIBOs (Producers, Importers, and Brand Owners) and PWPs (Plastic Waste Processors) must follow these steps:

  1. Documentation: Ensure all required documents are ready in PDF, JPG, or PNG format.

  2. Registration for login credentials: Self-register on the CPCB's centralized EPR portal to obtain login credentials.

  3. Submission of application: Log in with the credentials, complete the application form, and upload the necessary documents.

  4. Submission of application fee: Pay the application fee online through the integrated payment gateway.

  5. Processing of application: Applications are processed by SPCBs/PCCs (for operations in one or two states) or CPCB (for operations in more than two states).

  6. Grant of EPR Registration: If the application is complete, EPR registration certificates are issued digitally within 15 days. False information will lead to rejection or cancellation.

Fees for EPR Registration

A) Application Fees for PIBOs

Plastic Waste Generation (TPA) Application Fee (Rs.) ( <1000 MT - Rs.-10,000 ) (1000 MT-10,000 MT -Rs.- 20,000 ) (>10,000 MT- Rs.- 50,000)

B) Application Fees for PWPs

Production Capacity (TPA) Application Fee (Rs.) (<200MT-Rs.- 5,000) (200 MT-2,000MT-Rs.- 20,000) (>2,000MT- Rs.- 50,000)

C) Renewal & Processing Fees

  • EPR Renewal Fee: Same as the initial registration fee.

  • Annual Processing Fee: 25% of the initial application fee.

Validity, Renewal & Cancellation

  • A new registration is valid for one year, and renewal extends validity for three years.

  • Submit the renewal application four months before expiry, along with required documents.

  • Registrations may be cancelled or suspended if false documents are found.

Conclusion
If your plastic product falls under EPR, you must register through the centralized CPCB portal. Manufacturers, importers, brand owners, and plastic waste processors cannot conduct business without valid EPR registration.
